1. Acceptance of Terms
By creating an account, starting a run or otherwise using Atelier by Pilea (the "Service"), you agree to these Terms. If you use the Service on behalf of a company, you confirm you are authorized to bind it. If you do not agree, do not use the Service.
2. Description of the Service
Atelier is a team of AI agents built by Pilea. Agents browse the public pages of e-commerce websites, on desktop and mobile, to detect layout, content, campaign and functional issues. The most important findings are re-checked, findings may be reviewed by Pilea's QA team, and are reported with recommended fixes. You can launch runs manually or schedule them.
3. Accounts
You can sign up with Google or a work email. You must provide accurate information, including your work email, role, company name and the websites you want agents to analyze. You are responsible for keeping access to your account secure and for all activity under it. Accounts can be shared with teammates through seat invitations.
4. Acceptable Use
You agree not to:
- run agents on websites you do not own or are not authorized to analyze;
- use the Service to overload, disrupt or test the security of any website;
- resell, white-label or provide the Service to third parties without a written agreement (agencies may analyze client stores they are authorized to work on);
- attempt to extract the underlying models, prompts or rulebooks of the Service;
- use the Service for any unlawful purpose.
5. Credits, Plans & Payment
Welcome credits. When the first person from a company signs up with a work email, that company receives free welcome credits, as described on our website. They are shared by everyone at the same company and are valid for 14 days. Welcome credits have no cash value, cannot be transferred or exchanged, expire at the end of those 14 days and may change.
Credit packs and monthly plans. You can buy credit packs, or subscribe to a monthly plan billed in advance, by card through our payment provider, Stripe. Each run uses credits according to the pages, screens and agent it covers, and the cost is shown before the run starts. Credits bought in a pack do not expire. Prices are shown before you buy and exclude applicable taxes.
Contracted plans. For customers on an order form or contract, Pilea invoices by bank transfer, on the schedule and due dates set out in that agreement.
Late or failed payment. If a payment fails or is late, we may pause runs or suspend access until it is resolved. You can cancel a self-serve plan at any time; cancellation takes effect at the end of the current billing period and fees already paid are non-refundable, except where required by law.
6. AI-Generated Results
Agents use AI models to analyze pages. Results may be incomplete or inaccurate, and an issue that is not reported is not a guarantee that none exists. You remain responsible for deciding which changes to make to your website. Agents never place orders or enter payment details on the websites they analyze.
7. Intellectual Property & Feedback
Pilea owns the Service, including its software, agents, characters, content and rulebooks. You keep ownership of your website content and data, and grant Pilea a limited right to access and analyze the publicly available pages you submit, solely to provide the Service. Ratings, comments and other feedback you give on findings may be used to improve your rulebook and the Service.
8. Confidentiality
Each party agrees to protect the non-public business or technical information it receives from the other through the Service, and to use it only for the purposes of the Service.
9. Data & Privacy
Personal data is handled under our Privacy Policy. Our Security & Trust page describes how we protect data and which subprocessors we use. A Data Processing Agreement is available on request.
10. Service Availability
We aim to keep the Service and scheduled runs reliable, but we do not guarantee uninterrupted access. The Service is provided "as is", without warranties of any kind to the extent permitted by law.
11. Limitation of Liability
Pilea is not liable for indirect, incidental or consequential damages, including lost revenue or profits. Our total liability for any claim is limited to the fees you paid for the Service in the twelve months before the claim, or one hundred US dollars if you only used free credits.
12. Termination
You can close your account at any time. Contracted plans end as set out in the order form or contract. Either party may terminate with written notice if the other commits a material breach that is not cured within thirty days. We may suspend accounts that break the Acceptable Use rules.
13. Governing Law
If you contract with Pilea, Inc., these Terms are governed by the laws of the State of Delaware. If you contract with Pilea France SAS, they are governed by French law.
14. Changes to These Terms
We may update these Terms. We will notify active customers by email of any material change before it takes effect.
